Do I need a lawyer to write a will in Ontario?
No, Ontario law does not require a lawyer to prepare a will; however, having a lawyer draft your will is strongly recommended. Self-written wills often miss important legal details or include vague language. These legal gaps can create confusion during probate, so a Toronto lawyer helps make wills clear, compliant, and properly documented.
Can I create my will online without visiting your office?
Yes, for the most part. We handle the initial consultation, information gathering, document review, and drafting virtually. The only step that requires an in-person meeting is the final execution of the will, so the document is executed correctly, complies with legal formalities, and cannot be easily challenged later.
How long does it take?
Your draft will and documents are ready within 1–2 weeks for simple wills, or sooner with our urgent service (5 days or less, starting at an additional $400+HST per person).
What is the difference between a will and a Power of Attorney?
A will takes effect after death and governs how your estate is distributed. A Power of Attorney applies while you are alive and allows someone to make financial or personal care decisions for you if you become unable to. Both are essential parts of a complete estate plan, and we prepare both.
How does a will help with naming a guardian for my children?
Your will should name a guardian if you have children under 18 because, without one, the court will decide who takes that role. You can also name an alternate guardian in case your first choice is unable to act. Naming a guardian in your will gives your children stability and legal protection.
How often should I update my will?
Review your will after major life changes such as marriage, separation, the birth of a child, or the death of an executor or beneficiary. It is also wise to review it every few years to make sure it still reflects your current wishes.
Is a handwritten will valid in Ontario?
Yes. A holograph will is valid in Ontario if it is entirely in the testator’s own handwriting and signed, as permitted under the Succession Law Reform Act. However, handwritten wills are often unclear, incomplete, or challenged in court. A lawyer-prepared will reduces the risk of mistakes or disputes.
